The Nitty Gritty Details on the Process for Register of Probate

A while back, one of my posts was promoted with the comment "Inside the inside."  Well this is even more so.  Below the flip I have the nitty gritty details, focused towards what town and wards need to do to elect delegates to the caucus. Below the flip we have information from the Democratic Party.  Thanks to sco for giving us a preview.

If you are a Middlesex County town or ward chair and did not receive an e-mail from the Democratic Party, please contact them to let them know.  In the interim, I can forward the full e-mail to you as well if you contact me at KateDonaghue AT aol DOT com.  If you are a member of a town or ward committee in Middlesex County and would like to be a delegate, it would be prudent to contact your chair.  The core information is listed below the flip, but there is addtional material that it was not practical to include here.

As has been reported, the current Middlesex County Register of Probate John Buonomo has announced that he will resign his post.  As Mr. Buonomo's name will be the only name to appear on the September 16th Democratic Primary ballot in Middlesex County, it is possible that he will win the nomination and subsequently withdraw. As a result, the Massachusetts Democratic Party is preparing a procedure to nominate a subsititute candidate.

To select a subsititute candidate, Democratic Ward and Town Committees in Middlesex County must meet and select delegates to attend a caucus to be held on Wednesday, September 24th. This email contains important information for you regarding the caucuses to nominate a candidate for Register of Probate.

The Massachusetts Democratic Party strongly encourages you to hold a Democratic Town/Ward Committee meeting to select delegates in a window beginning Monday, September 22nd, at 5:00 PM and ending on Tuesday, September 23rd.  The delegates must be submitted to the Massachusetts Democratic Party via email by 11:59 PM on Tuesday, September 23rd.  The caucus will be held on Wednesday, September 24th, 6:30PM at a location to be determined.

Listed below is a timeline of the meetings and caucuses:
   * Sept 16 MA Primary
   * Sept 22, 5 PM last day and hour for nominee withdraw
   * Sept 22, 5 PM-Sept 23 town and ward committees meet to elect delegates to county-wide meeting
   * Sept 24, 6:30 PM county-wide meeting of elected delegates to select Democratic nominee
   * Sept 25, 5 PM deadline to submit nominees name to Secretary of Commonwealth  

Rules and Procedures for filling vacancies of a Party Candidate who has been nominated by winning a Primary and has withdrawn

1) The Town and Ward Committees of Middlesex County must meet and elect delegates by and from its members to a county meeting called by the Chair of the Party.  The county meeting may nominate a candidate to fill the vacancy.  Only members of Ward and Town Committees may vote and run for delegates to the county meeting.  Associate Members may not vote and may not be elected delegates to the county meeting.

2) Meetings of town and ward committees to elected delegates: - the Meetings should be called either after 5 pm on Monday September 22nd or on Tuesday September 23nd.  We encourage you to notify members now that a meeting MAY happen and announce the time and location.  If Register Buonomo wins the nomination on Tuesday AND resigns after receiving the nomination, then you will need to hold your meeting.

3) The Middlesex County Meeting of Delegates will then be held on Wednesday, September 24th at 6:30 p.m.  This meeting of delegates may nominate a candidate to fill the vacancy.  The nominee will be filed with the Secretary of State by 5:00 p.m. on Thursday September 25th.

Thanks Charley for promoting this and for a fun evening last night.

This thread outlines the process for selecting a candidate for the Democratic nomination if John Buonomo wins the primary but withdraws his name.

Why do we elect a register of probate at all? (5.00 / 1)
Shouldn't this be an appointed position?

Unfortunately, because there's a statute that says so (0.00 / 0)
The only way you're going to eliminate the election is to revoke General Law Chapter 54, Section 156; and to give some other entity -- presumably the SJC or the Administrative Office of the Probate Court -- superintendence of the position.

I agree that we should change the statute and not have elections.  Giving the SJC, Ad. Office of the Trial Court or Ad Office of the Probate and Family COurt is not the only alternative.  Registers of Probate and Family Court, Deed and Superior Court Clerks are elected - but Clerk Magistrates of the District Court (and the similar positions in other courts) are appointed in the same fashion as Judges - aplications made through the Judicial Nominating Commission, nomination name by Governor and approval by Governor's Council.

Both methods have pluses and minuses - but both better than election!  Maybe this dialogue should begin.
